1. Acceptance of Terms

By accessing or using AI Garden Design at aigardendesign.app or our mobile applications ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

AI Garden Design is an AI-powered tool that generates photorealistic garden and landscape design visualizations. Users upload photos of outdoor spaces and receive AI-generated redesigns in various styles. The Service is available via web and mobile applications.

3. Accounts

You must provide accurate information when creating an account.
You are responsible for maintaining the security of your account credentials.
You must be at least 13 years old to use the Service.
One account per person. Sharing accounts or creating multiple accounts to circumvent usage limits is not permitted.

4. Free and Paid Plans

Free plan: includes 3 garden design generations at no cost.
Paid plans: Monthly and Yearly subscriptions provide additional design generations. Current pricing is listed on our pricing page.
Design generation limits reset according to the billing cycle of your plan. Unused generations do not roll over.
We reserve the right to modify pricing with reasonable notice. Active subscriptions will be honored until the end of the current billing period.

5. Payments and Refunds

Payments are processed securely through Polar.
Subscriptions renew automatically. You may cancel at any time, and access will continue until the end of the current billing period.
Refunds may be issued at our discretion within 7 days of purchase if you have not used a significant portion of your design quota.

6. User Content

You retain ownership of photos you upload. By uploading, you grant us a limited license to process them for the purpose of generating your designs.
AI-generated designs are provided for your personal or professional use. You may use them for planning, sharing with contractors, or inspiration.
You must not upload content that is illegal, harmful, or infringes on the rights of others.
We may use anonymized, non-identifiable design outputs to improve our AI models and showcase examples in our gallery, unless you opt out by contacting us.

7. Prohibited Use

You agree not to:

Use the Service for any unlawful purpose.
Attempt to reverse-engineer, scrape, or extract the underlying AI models.
Resell or redistribute the Service without authorization.
Circumvent usage limits or abuse the free plan through multiple accounts.
Upload content that violates any applicable law or third-party rights.

8. Disclaimers

AI-generated designs are visualizations for inspiration and planning, not professional architectural or landscaping blueprints.
We do not guarantee that AI outputs will be perfectly accurate representations of how a real-world implementation would look.
The Service is provided "as is" without warranties of any kind, express or implied.
We are not responsible for any decisions or expenses incurred based on AI-generated designs.

9. Limitation of Liability

To the maximum extent permitted by law, AI Garden Design shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.

11. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
